Section 1 : Definitions

  • ‘Agreement’ is a reference to these terms and conditions, the privacy policy, any order form and payment instructions provided to you.
  • ‘Privacy policy’ means the policy displayed on our website/mobile application which details how we collect and store your personal data.
  • ‘You’, ‘Your’ and ‘Yours’ are references to you, the person accessing this website/mobile application and ordering any of our products from the website/mobile application or any other channels provided by Crispy Haven.
  • ‘We’, ‘Us’, ‘Our’ and ‘Crispy Haven’ are references to the company.
  • ‘Goods’ is a reference to any goods which we may offer for sale from our website/mobile application from time to time.
  • ‘Service’ or ‘Services’ is a reference to any service which we may supply and which you may request for from us, Crispy Haven.
  • ‘Food delivery’ is a reference to perishable goods and to any form of delivery service.
  • ‘website’ and ‘App’ are references to our website or our mobile application through which we offer our goods and services.
  • ‘Month’ is a reference to 30 days irrespective of the actual period of days present in any prescribed month.

Section 2 : Privacy Policy

  • When you visit the platform, we may collect certain data, including your IP address, contact information, email address, interests, preferences, and data profile regarding your online behavior.
  • We collect your data to better understand your needs, improve our services and products, send you promotional emails, conduct market research, and customize the platform according to your preferences.
  • We are committed to securing your data and preventing unauthorized access or disclosure through the implementation of advanced technologies and software.
  • Our Cookie Policy allows us to analyze web traffic and customize the platform based on your online behavior. Please note that cookies do not give us control over your computer and are used solely for improving your user experience.

Section 3 : Ordering

  • Any contract for the supply of goods and services from this website/mobile application is between you and Crispy Haven. You agree to take particular care when providing us with your details and warrant that these details are accurate and complete at the time of ordering. You also warrant that the credit or debit card or net banking details that you provide are of your own credit or debit card and that you have sufficient funds to make the payment.
  • Any goods and services purchased from this website/mobile application are intended for your use only and not for resale.
  • When ordering from this website/mobile application you may be required to provide an e-mail address and password. You must ensure that you keep the combination of these details secure and do not provide this information to any third party.
  • We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure. During instances of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the website/mobile application.
  • Any order that you place with us is subject to product availability, delivery capacity and acceptance by us. When you place your order online, we will send you an auto-generated confirmation mail/notification in any form about the same. You must inform us immediately if any details are incorrect. If the product for which you placed the order is not available or if we are not able to deliver to your location, we will inform you through a phone call or SMS or E-mail.

Section 4 : Pricing & Payment

  • All prices listed on the website/mobile application are correct at the time of publication. We also reserve the right to alter the food menu on the website/mobile application.
  • All prices for delivery by Crispy Haven or a third-party provider assigned by Crispy Haven listed on the website/mobile application are correct at the time of publication; however, we reserve the right to alter these in the future.
  • The food delivered to you is prepared or manufactured by ourselves from our Kitchen. However, we may outsource food from a third-party company in future.
  • The total price for the food including taxes will be displayed at the time of checking out your order. Full payment must be made for all items dispatched-ordered by online payment, e.g. credit, debit card, or bank transfers. And we reserve the rights to alter these prices in future.
  • If you choose online payment, you must pay for your order prior to delivery. To ensure that shopping online is secure, your debit/credit card details will be encrypted, thereby preventing the possibility of any third-party accessing your information.
  • If a customer makes payment for the same order more than once by mistake, the extra amount will be refunded via the same gateway to the source within 15 to 20 working days.

Section 5 : Delivery

  • Delivery timings provided are approximate and may vary due to factors beyond our control, such as traffic and weather conditions.
  • Orders will be delivered to the addresses designated by you at the time of ordering, using our own delivery network or third-party delivery services.
  • If you fail to accept the delivery or provide appropriate instructions, all risk and responsibility for the goods will pass to you.
  • It is your responsibility to ensure that adequate arrangements, including access, are in place for the timely delivery of your order.
  • While we strive to meet the estimated delivery time, we cannot be held liable for any losses or expenses arising from late delivery.
  • If we are unable to deliver to your location, we will inform you and make arrangements for cancellation or delivery to an alternative address.
  • In the event of a failed delivery due to reasons beyond the customer’s control, we will refund the full amount within 15 to 20 working days.

Section 6 : Cancellation & Refund Policy

If you have subscribed for daily/weekly/monthly plan, orders can be cancelled any part of the time preferably by phone or Crispy Haven mobile application and the amount will be refunded subjected to following conditions:
  1. In case of daily plan:
    • When you have opted for any meal plan and if you apply for cancellation 4 hrs prior to the delivery of the 1st meal then total cost of the subscription will be refunded, else 80% of the cost of subscription will be refunded to your wallet.
  2. In case of weekly plan:
    • When you have opted for any meal plan and if you apply for cancellation 4 hrs prior to the delivery of the 1st meal then total cost of the subscription will be refunded, else 80% of the cost of subscription will be refunded to your wallet.
    • When you have opted for any weekly plan (ie: 6 meals per week) and for example if you apply for cancellation after the 3rd meal is delivered and 4 hrs prior to the delivery of 4th meal, then 80% of the cost of remaining 3 meals will be refunded to your wallet.
  3. In case of monthly plan:
    • When you have opted for any meal plan and if you apply for cancellation 4 hrs prior to the delivery of the 1st meal then total cost of the subscription will be refunded, else 80% of the cost of subscription will be refunded.
    • When you have opted for any monthly plan (ie: 26 meals per month) and for example if you apply for cancellation after the 15th meal is delivered and 4 hrs prior to the delivery of 16th meal, then 80% of the cost of remaining 11 meals will be refunded to your wallet.
  4. We may cancel an order if the product is not available for reasons that are not within our control. We will notify you if this is the case and return any payment that you have made.
  5. If the cancellation was made in time as per above mentioned conditions, we will refund or re-credit to your debit or credit card with respective amount within 14 days.
  6. In the unlikely event that we deliver a wrong item, you have the right to reject the delivery of the wrong item and you shall be fully refunded for the missing item. If we can only do a partial delivery (a few items might be not available), we would inform you or propose a replacement for missing items. You have the right to refuse a partial order before delivery and get a refund.
  7. Meal subscription plans have to be used during the period of validity. In case of the user not availing the meals during the specified period unless the cancellation is applied, the meals will lapse. Refund or extension of lapsed meal will not be possible. This is applicable to all subscriptions offered under Meal Plans by Crispy Haven.
  8. Stainless Steel food boxes will be given to customer who subscribe for weekly or monthly plans. And those boxes must be returned back the next day safely and washed to the delivery person and receive new food boxes present day meal. These boxes are not for personal use, they must be returned safely back to Crispy Haven at the end of subscription plan.

Section 7 : Information

  • You agree to provide us with accurate and complete information wherever and whenever we have requested information to provide delivery.
  • You authorize us to use, store or otherwise process your personal information in order to enable the delivery of food items to you and for marketing and credit control purposes. These purposes may include the disclosure of your personal information to selected third parties from time to time where we believe that the services offered by such third parties may be of interest to you or where this is required by law or in order to provide delivery of food items.
  • You are entitled to request a copy of the personal information we hold on you. Please contact us if you wish to request this information.

Section 8 : Complaints

We take complaints very seriously and aim to address your concerns within 5 business days. All complaints should be sent to crispyhaven@gmail.com. The Customer Support Team can also be reached at +91 991 0599 254.

Section 9 : Limitation of Liability

  • Great care has been taken to ensure that the information available on this website/mobile application is correct and error free. We apologize for any errors or omissions that may have occurred. We cannot warrant that use of the website/mobile application will be error-free or fit for purpose, timely, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website/mobile application and we do not make any warranty whatsoever, whether express or implied, relating to fitness for purpose, or accuracy.
  • By accepting these terms of use, you agree to relieve us from any liability whatsoever arising from your use of information from any third party, or your use of any third-party website/mobile application, or your consumption of any food or beverages ordered from us.
  • We disclaim any and all liability to you for the supply of the food items to the fullest extent permissible under applicable law. If we are found liable for any loss or damage to you such liability is limited to the amount you have paid for the relevant items. We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits, howsoever arising. This limitation does not apply to personal injury or death as a direct result of our negligence.
  • We do not accept any liability for delays, failures, errors, omissions, or loss of transmitted information, viruses or other contamination or destructive properties transmitted to you or your computer system via our website/mobile application.
  • We shall not be held liable for failure or delay in delivery arising from any act or omission outside our reasonable control including, but not limited to, war, riot, civil commotion, compliance with any law or governmental order, rule, regulation or direction and acts of third parties.
  • If we have contracted to provide identical or similar orders to more than one customer and are prevented from meeting our obligations to all due to force majeure, we may decide at our absolute discretion which orders we will fill and to what extent.
  • Products are provided for private domestic and consumer use only. We do not accept liability for indirect loss, consequential loss, loss of data, income, profit, property, or claims from third parties arising out of use of the website/mobile application or for any products/services purchased from us.
  • We take all reasonable steps to prevent Internet fraud and ensure security of data, but cannot be held liable in the extremely unlikely event of a breach in our servers or those of third parties.
  • In the event of voucher/discount code abuse or suspected fraud, Crispy Haven may block the shopper/customer and refuse future service. Compensation may also be sought from violators.
  • We strive to maintain food quality. In case of reported poor quality, we will gather majority opinion of customers receiving the same food on that day. Widespread quality issues will be handled accordingly.

Section 10 : General

  • All prices are in INR and inclusive of taxes unless otherwise indicated.
  • We may subcontract any part of the product catalogue or services and assign our rights under these terms without your consent or any notification.
  • We may alter or vary the terms and conditions at any time without notice to you.
  • Payment must be made at order placement by credit card, debit card, net banking, or cash at delivery. Failure to pay on time will result in order cancellation.
  • Do not use or launch automated systems or programs in connection with our website/mobile application or its ordering features.
  • Do not collect or harvest any personally identifiable information from the website, use communication systems provided by our website/mobile app for solicitation, solicit users with respect to their submissions, or publish/distribute vouchers or codes, or scrape or hack the website.
  • Once registered, you will receive all forms of promotional SMS, e-mails and notifications to keep you updated with our offers and information.
  • These terms, privacy policy, order form and payment instructions constitute the entire agreement between you and us. In case of any conflict, these terms and conditions shall prevail.
  • If any term or condition is deemed invalid, illegal or unenforceable, such provision shall be deemed deleted and the rest of the Agreement will continue.
  • These terms, contracts, and non-contractual obligations arising out of them will be governed by and construed in accordance with the laws of India. The parties submit to the exclusive jurisdiction of the courts of India.
  • No delay or failure on our part to enforce our rights or remedies shall constitute a waiver unless in writing.
  • All dealings, correspondence, and contacts between us shall be made in the English language.
